Family Court Litigation Course
The Family Court Litigation Course is designed to assist separated parents to learn and develop fundamental and advanced skills and strategies of resolving their Parental Disputes in the Family Court. How to initiate and respond to applications and manage their cases using a pragmatic child-focused litigation strategy
Modules: This course consists of 4 Modules each 3 hours delivered weekly over 4 weeks period. Upon registration, prospects can choose any of the 4 modules or register for completing all 4 modules depending on their circumstances and needs.
M1 – Family Court Early Stages – up to 3 hours
Ideal participants: Current or prospect Applicants or Respondents involved in any Family Court Proceedings.
Module Contents: An overview of the Family Justice System, legislation, and general proceedings types and tracks. How to initiate and respond to applications and conferences, when and how to do things according to the prescribed rules, writing affidavits, memoranda and submissions.
M2 – Family Court Process – up to 3 hours
Ideal participants: Current or prospect Applicants or Respondents involved in any Family Court Proceedings.
Module Contents: How to deal with Court hearings. How to initiate and respond interlocutory matters and notices. The evidential requirements in the family court. and how the evidence is assessed in the family court, types of evidence, cross-examination and witnesses summons.
M3 – Care of Children Disputes – up to 3 hours
Ideal participants: Applicants or Respondents involved in disputes under the Care Of Children Act 2004.
Module Contents: The fundamentals of initiating and responding to applications , Setting a pragmatic child-focused litigation strategy. gain insight into the Court’s legal and psychological perspective and assessment criteria for matters relevant to the Care of Children disputes.
M4 – Family Violence Litigation – up to 3 hours
Ideal participants: Applicants or Respondents involved in disputes under the Family Violence Act
Module Contents: The fundamentals of initiating and responding to applications under the Family Violence Act 2018, dealing with Police safety orders, setting a pragmatic realistic litigation strategy, gain insight into the Court’s assessment criteria relevant to the Family Violence.
